1. Acceptance of Terms
By accessing or using UpscalerX ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to update these terms at any time.
2. Service Description
UpscalerX provides AI-powered image upscaling services. Users upload images, and the Service processes them to produce higher-resolution versions. The Service is provided "as is" and we strive to maintain high availability but do not guarantee uninterrupted service.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information when creating an account. One person per account — sharing accounts is prohibited. You must be at least 13 years old to use the Service.
4. Credits & Billing
Credits are consumed when using the upscaling service. Free accounts receive 15 credits upon signup. Additional credits can be purchased through our billing system. Credits are non-refundable and non-transferable. Subscription plans auto-renew unless cancelled.
5. Acceptable Use
You agree not to: upload illegal or infringing content, attempt to reverse-engineer the Service, use the Service for automated high-volume processing without a proper plan, circumvent rate limits, or upload content that violates third-party rights.
6. Intellectual Property
You retain all rights to images you upload. Upscaled results are your property. The Service itself, including our AI models, algorithms, and branding, is our intellectual property and may not be copied or reproduced.
7. Limitation of Liability
UpscalerX is not liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim. Images are processed "as is" without guarantees of specific results.
8. Termination
We may suspend or terminate accounts for violations of these terms. You may terminate your account at any time through settings. Upon termination, your data will be deleted within 30 days. Prepaid credits are forfeited upon termination for cause.
9. Governing Law
These terms are governed by the laws of India. Any disputes shall be resolved through binding arbitration. The Service is operated from India and makes no claim regarding compliance with laws of other jurisdictions.
